ICE Is Waiting at the Weigh Station:
The Crackdown on Illegal-Immigrant Truckers.

On May 27, officers from Homeland Security Investigations’ Harrisonburg, Virginia office stopped a tractor-trailer on Interstate 81 and took the man behind the wheel into custody: Lins Dos Santos-Melo, described by ICE as an illegal alien from Brazil. He was carrying a valid Massachusetts driver’s license. What he was not carrying was a commercial driver’s license — the credential the rig required. ICE announced the administrative arrest on June 17; no criminal charges have been announced.

The stop was not luck. As the Washington Examiner’s Anna Giaritelli reported on July 8, federal immigration officers are now working highway weigh stations alongside state inspectors, checking commercial drivers’ licensing and immigration status at the choke points every loaded truck must pass. It is one arm of the broadest federal squeeze on noncitizen commercial drivers in modern history: roughly 200,000 CDL holders under review, about 28,000 licenses already gone.

Behind the enforcement statistics is a body count: five named crashes in eleven months, thirteen deaths, and a licensing pipeline that runs through Massachusetts, California, and New York — three states whose Democratic governments issued commercial credentials the federal government now says should never have existed.

§ 01 / ICE at the Weigh Stations

The weigh station is an old piece of highway infrastructure with a new job. Every loaded truck eventually has to cross a scale, which makes the scale house the one place federal officers do not have to go looking for commercial drivers — the drivers come to them. Giaritelli’s reporting describes immigration officers embedded at those inspection points, running credentials alongside the troopers who have always checked weights and logbooks; the Examiner’s editorial board, surveying the results on July 12, called the crackdown “welcome.”

The Dos Santos-Melo arrest shows why the checkpoint work matters. Here was a driver a state had documented — Massachusetts issued him a valid ordinary driver’s license — hauling a rig that required a commercial credential he did not have. The arrest was administrative, a deportation matter rather than a criminal charge; ICE’s release names no employer and alleges no crash. But acting ICE Director David J. Venturella framed the stakes in terms any motorist on I-81 would recognize.

§ 02 / The Body Count

The crackdown did not start as an abstraction. Between August 2025 and July 2026, five crashes involving noncitizen truck drivers killed thirteen people. On August 12, 2025, truck driver Harjinder Singh attempted an illegal U-turn on the Florida Turnpike; three people in a minivan died. He has pleaded not guilty, is presumed innocent, and faces up to 45 years if convicted. On October 21, Jashanpreet Singh triggered a pileup on Interstate 10 in Ontario, California that killed three. He pleaded guilty to vehicular manslaughter and is due for sentencing on or about July 14, 2026 — and prosecutors dropped a separate DUI count after his toxicology came back negative, a correction worth stating plainly.

Under the magnifying glass, the paperwork stopped adding up: federal sampling found more than a quarter of examined California non-domiciled CDLs improperly issued, and the driver ICE stopped on I-81 had no commercial license at all.

On November 24, 2025, Rajinder Kumar — who DHS says entered the country near Lukeville, Arizona in November 2022 and held a California CDL — was accused of causing an Oregon crash that killed William Micah Carter and Jennifer Lynn Lower, newlyweds married sixteen days. ICE arrested him in April 2026, then deported him before trial; per The Blaze, he may never face a jury — accused, nothing more. On February 3, 2026, Bekzhan Beishekeev — paroled into the country through the CBP One app at Nogales in December 2024, under the Biden administration — crashed in Jay County, Indiana, killing four Amish men: Henry Eicher, 50, Menno Eicher, 25, Paul Eicher, 19, and Simon Girod, 23. He is charged with four counts of reckless homicide plus three additional counts, faces a maximum of roughly 28.5 years, and is presumed innocent.

Then, on July 1, 2026, Pennsylvania State Trooper Michael E. Pahira Jr., 44, was killed on I-81 — the same corridor where Dos Santos-Melo was stopped. Michael Bon, 33, a Haitian national, is charged in his death and is presumed innocent. Bon’s paper trail, documented by WVIA, is the part officials keep pointing to: he entered at Fort Lauderdale on humanitarian parole in July 2024, was denied Temporary Protected Status, had his parole terminated in June 2025 with an order to leave the country — and held a Massachusetts non-domiciled CDL issued in March 2025 and renewed in February 2026, eight months after he was told to go. Readers of this site will recognize the pattern from the death of UMass soccer star Toby Forsythe, 21, in a crash involving truck driver Bekhzod Asrarov.

Under Gov. Maura Healey (D-MA), the state issued Bon a non-domiciled commercial license — and renewed it after the federal government ordered him to leave. Massachusetts is also leading the pushback: Attorney General Andrea Joy Campbell (D) heads a 19-state coalition opposing the Transportation Department’s licensing rule.

California’s numbers are worse. The state’s own DMV admitted it illegally issued 17,000 non-domiciled CDLs, according to the U.S. Department of Transportation, and federal sampling found more than 25 percent of examined California non-domiciled CDLs improperly issued. New York posted the worst sampled rate in the country — 53 percent unlawful, per Secretary Sean Duffy (R)’s December 12, 2025 presser. Gov. Gavin Newsom (D-CA)’s office has pushed back hard, arguing California’s commercial drivers post a fatal-crash rate roughly 40 percent below the national average — a safety-record defense that does not answer the DMV’s own admission that thousands of the licenses were unlawful in the first place.

The federal campaign began on April 28, 2025, when President Trump signed the executive order “Enforcing Commonsense Rules of the Road for America’s Truck Drivers,” reviving English-proficiency enforcement for commercial drivers. Duffy’s FMCSA put out-of-service criteria into effect on June 25, 2025; more than 1,500 drivers were sidelined in the first 30 days, roughly 9,500 by December, and over 20,000 to date. Then came the licensing rule itself: an emergency interim final rule on September 29, 2025, an administrative stay from the D.C. Circuit on November 13, and a final rule published February 13, 2026 — effective March 16 — that limits non-domiciled CDLs to H-2A, H-2B, and E-2 visa holders and requires immigration-status verification through the federal SAVE system.

The out-of-service era: FMCSA enforcement has sidelined more than 20,000 drivers for failing English-proficiency checks since June 2025, and roughly 28,000 licenses have been removed or rescinded.

The money followed the rule. In October 2025, the Transportation Department withheld $40.7 million from California; on January 7, 2026, Duffy pulled another $160 million — roughly $200 million in total — and threatened New York with $73.5 million more. Congress is moving in parallel: Dalilah’s Law, named for Dalilah Coleman, a five-year-old hurt in a June 2024 crash, would bar illegal aliens from holding CDLs outright, with Sen. Jim Banks (R-IN) carrying the Senate version. President Trump endorsed it from the State of the Union podium on February 25, citing 17 fatal 2025 crashes and 30 deaths.
